How long does a divorce typically take in Hampton Roads?
Everyone wonders how long a divorce will take, but it’s difficult to say as every divorce is incredibly different. Uncontested divorces – where the couple agrees on the major terms of the divorce – can generally take anywhere between six months and a year. However, couples need to have been living separately for at least six months if they don’t have minor children, or at least one year if they do have children.
Contested divorces often take much longer as couples have trouble agreeing on issues such as custody or property division. Contested divorces are also often filed on grounds of fault, such as adultery or abandonment. In these cases, you may need to provide evidence of the fault, which can take longer in finalizing a divorce.
When you work with me, I will stay on top of your case and help move it forward as much as possible so you’re not stuck in limbo for too long. I will keep you informed every step of the way.
What should I include in a prenuptial agreement in Virginia?
A prenuptial agreement is a legal contract that allows you and your soon-to-be spouse to protect your assets and finances during your marriage in the event of a divorce. Prenups are increasingly popular as they provide security for couples in the future if they decide to separate. A prenup can cover any of the following:
- Business interests
- Income
- Spousal support
- Retirement accounts
- Bank accounts
- Investments
- Inheritances
- Marital and separate property
- Life insurance
Creating a strong prenuptial agreement requires careful attention to detail and a thorough review of your finances and assets. I can help you consider all the factors and establish an effective prenup that will give you the peace of mind you need as you move forward with your marriage.
