I Advocate For Victims With Homeowner Injury Claims

A major component of premises liability claims is the concept that property owners are responsible for injuries on their property. This applies to commercial properties, and it also applies to homeowners. If you have an injury from an accident in someone else’s home, it may be time to talk to a personal injury attorney.

My name is Melissa Kelley, and I’m an attorney who represents injured people in Hampton Roads. One of the first hurdles people have in filing a homeowner injury claim is the concern about starting a fight with a neighbor. No one wants to do that. However, if you don’t take that step, you may find yourself with bills you can’t pay on your own.

The Obstacle To Your Compensation

When it comes to injuries on someone else’s property, all cards are on the table. Usually, the homeowner would volunteer to cover those injuries. However, the homeowner doesn’t usually get to make that choice; instead, their insurance company pays for the injury.

And insurance companies largely try to pay as little as possible. I worked as a litigation manager at an insurance company, and I understand how their processes work. Home insurance is a business with a for-profit model. But they have contracts and duties, and I will hold them to it.

Common Types Of Homeowner Injury Claims

Across Virginia, people are injured in homes in many ways. The most common ways include:

  • Attractive nuisances: Empty pools or unattended wooded areas can draw children and adolescents. These areas can frequently become dangerous due to wear and tear or time.
  • Electrical hazard: Electrical fences or buried wiring can become a hazard to people without anyone realizing it. Electrical injuries are exceptionally dangerous.
  • Out-of-code work: The do-it-yourself movement has drawn many people to it who will create new structures and spaces on their property. However, if these are not to code, they can be potentially dangerous to anyone who uses them.
  • Wild animals: People with significant undeveloped property may have wild animals of many types living there. These animals can injure people on the property.

The right to safety doesn’t extend only to people lawfully on someone else’s property, but also – in a limited capacity – to trespassers as well.
